I grandi carnivori in Italia e in Svizzera: tra esigenze di tutela e limiti strutturali del diritto amministrativo

Abstract

This chapter deals with the legislation on the protection of large carnivores in Italy, with comparisons with similar provisions in the Swiss Confederation. Given the factual circumstances, the chapter focuses on the specific case of bears and wolves, on which doctrine and national courts, including the Italian Constitutional Court, have already dealt with. Similarly, wolves are the subject of special attention in ‘Italian Switzerland’. Active and passive management models will be analyzed, as well as the main case law from national administrative courts and of the EU Court of Justice, with particular reference to the principles of precaution, proportionality and animal welfare.
