Abstract
The article aims to analyse the path taken by the Association of Southeast Asian Nations (ASEAN) in drafting the Declaration on environmental rights. Even though it presents a potential role for the integration of environmental rights and human rights, significant critical issues have been identified, including the need for effective implementation at the regional level and the lack of provisions for the protection of vulnerable communities, including indigenous peoples and so-called ‘environmental defenders’, who are often hindered by strategic lawsuits against public participation.
