The Problematic Relationship between Traditional Knowledge and the Commons
abstract
This chapter investigates two propositions that have become premises of the international debate around the question of the protection of traditional knowledge: first, that the protection of traditional knowledge is primarily a question of the rights of Indigenous Peoples; and, secondly, that the form of the protection of TK is primarily a question of intellectual property law.
