abstract

The first jurisprudential order on the new rent-to-buy contract, issued by the court of Verona on 12th December 2014 n. 95, allows a reflection on this type of agreement. This contract - which allows a party to immediately use a building, and afterwards make a decision on the purchase using some of the money already paid - is analysed, in its structure, comparing it to the legal instruments used before its introduction. Through this analysis, it can be inferred that this contract is only formally recognised by the law, but not strictly codified in its content, allowing the parties involved to have considerable contractual freedom. Therefore, it may efficiently be used in B2B negotiations.
