abstract

This paper investigates, in an evolutive perspective, the main characteristics of the companies in general – of any type – under the Italian Civil Code: among them a special attention is given to the requirement of performing an economic activity, but not necessarily a business one. Moreover, the Author examines whether, between commercial and agricultural businesses, the companies are still allowed to perform civil activities, drawing the conclusion that it will be possible, particularly in the light of the recent laws referring to the professionals’ companies. In addition, the thesis according to which the target of making profits, although widely pursued, is not mandatory for the companies themselves is asserted.
