dc.description.abstract	The article calls into question the legal nature of the contract between the operator of a social network (Facebook) and the users, by examining the main terms of use unilaterally drawn up by the operator. The analysis leads to recognizing the existence of an exchange between the parties, since the right to use the platform is granted to the user on the basis of the collection and exploitation of his personal data by the social network.

abstract

The article calls into question the legal nature of the contract between the operator of a social network (Facebook) and the users, by examining the main terms of use unilaterally drawn up by the operator. The analysis leads to recognizing the existence of an exchange between the parties, since the right to use the platform is granted to the user on the basis of the collection and exploitation of his personal data by the social network.
